Minutes of the Organizational and Regular Meeting of the Town Board of the Town of Kirkland held at the Town of Kirkland Municipal Building, 3699 State Route 12-B, Clinton, Oneida County, New York on January 2, 2013, at 7:00 p.m.

Supervisor Meelan called the organizational meeting to order and asked all present to stand for the Pledge of Allegiance.
The Oath of Office was administered by Town Justice Jay G. Williams III to newly elected Town Clerk, Caryl A. Galinski.
The following motions were introduced for the 2013 appointments and salaries:
That the annual salaries for Councilmen O'Neil, Lewis, Lomanto and Arcuri
be the sum of $5,470 each.
That the additional salary for Councilman Arcuri as Sewer Liaison be the sum of $6,000 for the additional duties associated with the Clark Mills Sewer Plant Upgrade.
That the annual salaries for Paul Heintz and Jay Williams III, Town Justices, be the sum of $16,006 each
That Patricia Curtacci and Rozanne D'Acunto be appointed Justice Clerks and the annual salaries be $11,254 each.
That the annual salary for Town Supervisor Robert Meelan be $17,470.
That Supervisor Meelan appoint RoseMarie Arcuri as Town Budget Director and the salary be $7,616.
That Supervisor Meelan appoint Michael D. O'Neil, Deputy Town Supervisor, with annual salary of $1,000.
That RoseMarie Arcuri be appointed Supervisor's Secretary and the annual salary be $43,152.
That Patricia Maxam be appointed Assistant Supervisor's Secretary and the annual salary be $27,080.
That the annual salary for Sarah McCullough, Receiver of Taxes, be the sum of $9,806.
That the Receiver of Taxes appoint Garry Colarusso as Deputy Receiver of Taxes at the annual salary of $1,000.
That Nina Caporale, be appointed Town Assessor, with the remainder of the term to expire September 30, 2013 and the annual salary to be $17,340.
That Bernard Szarek be appointed Clerk to the Assessor and the salary be $10.00 per hr.
That each member of the Board of Assessment Review be paid an annual salary of $318.
That the annual salary for Caryl Galinski, Town Clerk, be the sum of $43,073.
That the Town Clerk appoint Donna Maxam full-time Deputy Town Clerk at an annual salary of $22,440.
That the annual salary of Caryl Galinski, Registrar of Vital Statistics, be $1,574.
That the annual salary of Donna Maxam, Deputy Registrar of Vital Statistics, be $1,409.
That the salary for Marc Goldberg, Sub Registrar of Vital Statistics, be $11.37 per hour.
That the Town Board appoint Felt Evans, L.L.P. as Attorney for the Town at a sum of $45,000 for general matters and $20,000 for litigation and non-retainer matters.
That Caryl Galinski and Donna Maxam be appointed Dog Control Clerks and the annual salary be $3,232 each.
That the annual salary for Jonathan Scott, Superintendent of Highways, be the sum of $58,746.
That Jonathan Scott be appointed MS4 Officer (Municipal Separate Stormwater Sewer System) and the stipend be $5,253.
That the Superintendent of Highways appoint Paul Grube as Deputy Highway Superintendent and the stipend be $6,378 in addition to his MEO pay.
That the Highway Department employees' salaries are set by the union contract.
That Michael Orsino be appointed Recreation Maintenance Superintendent and the annual salary be $49,154 plus a $9,000 stipend.
That Wayne Clipston be appointed Assistant to Michael Orsino for the Parks and Recreation Department and a stipend of $5,000 in addition to his Recreation Maintenance Worker pay.
That Jeaneen Seward be appointed Recreation Attendant and the annual salary be $19,380.
That Nathan Meyer, Jr. be appointed Director of the Senior Citizen Center and the annual salary be $12,329.
That Supervisor Meelan appoint Richard L. Williams as Town Historian and the annual salary be $1,159.
That Supervisor Meelan appoints himself as Town Police Commissioner at no salary.
That Daniel English be appointed Chief of the Kirkland Police Department and the annual salary be $68,874.
That Charles Kriz be appointed full time Town Police Officer and the annual salary be $55,225. That Gene Sinardo, Jr. be appointed full time Town Police Officer and the annual salary be $51,777. That Peter Cania IV be appointed full time Town Police Officer and the annual salary be $42,877. That Fredrick Peck and Christopher Paravati be appointed full time Town Police Officers and the annual salary be $38,349 each. That Shawn Occhipinti be appointed full time Town Police Officer and the annual salary be $40,361.
That Horace Knight, Rex Mazur, David Amodio, Daniel Buley, Robert Roberts be appointed part-time Town Police Officers and the rate of pay be $20.50 per hour.
That James Zwijacz and Richard Stanek be appointed part-time Town Police Officers and the rate of pay be $18.44 per hour
That Julie Rotondo be appointed secretary for the Kirkland Police Dept. and the annual salary be $21,213.
That Kevin Griffin be appointed Building Inspector and Flood Control Officer and is one of the Code Enforcement Officials at the hourly rate of $28.44.
That Michael Griffin be appointed Zoning & Code Enforcement Officer and Fire Code Inspector and is one of the Code Enforcement Officials and the annual salary be $14,640.
That Michael Getnick be appointed Chairman and Counsel and member of the Zoning Board of Appeals and the annual salary be $11,010.
That Anita Fitzgerald be reappointed as a member of the Zoning Board of Appeals with the term to expire December 31, 2016.
That each Zoning Board of Appeals member be paid the annual salary of $1,850.
That John Cosgrove be appointed Secretary to the Planning Board and the annual salary be $7,329.
That Melinda Albertine be appointed Planning Coordinator and the annual salary be $17,000.
That Elizabeth Braun be appointed part-time Planning and Codes Clerk and the salary be $11.25 per hour.
That Edward Kaido be reappointed as a member of the Planning Board with term to expire December 31, 2017.
That Planning Board members be paid the annual salary of $1,468 and Chairman $1,836.
That the rate of pay for Transfer Station Attendant is not to exceed $16.50 per hour.
Further, that Town officials be allowed a mileage allowance for use of personally owned automobiles used for Town business at the rate of 40 cents per mile.
That the Clinton Courier be named the Town Official Newspaper.
That the two regular monthly meetings of the Town Board be held at 7:00 p.m. at the Town of Kirkland Municipal Building, 3699 State Route 12-B, Clinton, with the first regular meeting to be held the second Monday of each month except in the months of January, February, July, October and November.
That the National Bank and Trust Company be named Depository of Town Funds and that the Town Supervisor is authorized to sign contractual agreements with NBT, N. A. for all banking programs and purposes.
That the salaries of Town Officials and employees shall be paid bi-weekly with the following exceptions:
--- Dog Control Clerks, Justice and Justice Clerks, Receiver of Taxes, Town Supervisor, Town Board members and Zoning & Codes Enforcement Officer shall be paid monthly.
---Deputy Town Supervisor, Registrar of Vital Statistics and Deputy Registrar, Historian and members of the Board of Assessment Review, Planning Board & Zoning Board of Appeals shall be paid annually.
---Budget Director to be paid bi-annually; First payment in June and second payment after the budget is adopted by the Town Board.
Supervisor Meelan made Committee assignments for the year 2013 as follows:

RESOLUTION #1
Upon motion of Councilman O'Neil, seconded by Councilman Lewis the following resolution was presented:
RESOLVED, that the Town Board approve the preceding appointments, salaries and directives.
Upon the roll call vote, five voted aye, none opposed and the resolution was declared adopted.
RESOLUTION #2
Upon motion by Councilman Arcuri, seconded by Councilman Lewis the following resolution was presented:
RESOLVED, that the Town Board adopt the Cash Management and Investment Policy as printed in the Town of Kirkland Code Book.
Upon the roll call vote, five voted aye, none opposed and the resolution was declared adopted.
Michael Griffin, Codes Enforcement Officer, reported to the Town Board regarding a complaint received regarding an excavation project on Kellogg Street that is reported to be causing mud and water runoff to neighbors' properties. Mr. Griffin said that he and Jon Scott, MS4 Officer, have been at the site and spoke with the owner of the property. The owner's father is doing the work himself and he has complied with everything he was asked to do. Codes Officer Griffin said that there are no code violations.
Supervisor Meelan said that he was surprised to learn that there is nothing in the Town Code to protect neighboring property owners from being adversely affected by a neighbor's project on his own property. The Supervisor and Town Board asked Attorney Hallak to draft such a provision to be included in our Town Code.
Attorney for the Town Hallak handed out copies of a draft of proposed Local Law #1 of 2013 regarding an open container ordinance to be addressed at the next meeting.
Supervisor Meelan complimented Jon Scott and his Highway Crew for good work clearing the roads during the recent snow storms.
Police Chief Daniel English said that the monthly report had been distributed. There were 166 calls in December; 119 in the Town, 44 in the Village and 3 outside the Town.
The Sanitary Inspector's Reports were reviewed by the Town Board.
Supervisor Meelan recognized the public in attendance. Paul and Melissa Drejza, 7031 Kellogg Street, were present to address the Town Board regarding stormwater run-off resulting from a massive excavation project, including removal of 7-10 trees, being done at 7041 Kellogg Street last summer. Mr. Drezja asked the Town Board to consider a provision in the Town Code that a property owner may not alter his property in such a way that would adversely affect another landowner's property.
There being no further business to come before the Town Board, upon motion by Councilman Arcuri, seconded by Councilman O'Neil, the meeting was adjourned at 7:42 p.m.
