Minutes of the Organizational and Regular Meeting of the Town Board of the Town of Kirkland held at the Town of Kirkland Municipal Building, 3699 State Route 12-B, Clinton, Oneida County, New York on January 4, 2012, at 7:00 p.m.

          (At 7:00 p.m. the Oath of Office was administered by Dianne Tuttle, Town Clerk, to newly elected Councilman Anthony F. Arcuri and Receiver of Taxes Sarah McCullough, re-elected Supervisor Meelan, Councilman Michael D. O'Neil, Councilman Fred A. Lomanto and Town Justice  Paul B. Heintz).

  Supervisor Meelan called the organizational meeting to order and asked all present to stand for the Pledge of Allegiance.   

The following motions were introduced for the 2012 appointments and salaries:

          That the annual salaries for Councilmen O'Neil, Lewis, Lomanto and Arcuri

be the sum of $5,363.  each.

          That the annual salaries for Paul Heintz and Jay Williams III, Town Justices, be the sum of $15,692 . each                    

          That Patricia Curtacci and Rozanne D'Acunto be appointed Justice Clerks and the annual salaries be $11,033. each.                                                               That the annual salary for Town Supervisor Robert Meelan be $17,127.

 That Supervisor Meelan appoint Rosemarie Arcuri as Town Budget Director and the salary be $7,467.        

          That Supervisor Meelan appoint Michael D. O'Neil, Deputy Town Supervisor and the annual salary be $1,000.

          That Rose Marie Arcuri be appointed Supervisor's Secretary and the annual salary be $42,306.

          That Julie Rotondo be appointed Assistant Supervisor's Secretary and the annual salary be $20,797.

          That the annual salary for Sarah McCullough, Receiver of Taxes, be       the sum of $9,614.

          That the Receiver of Taxes appoint Garry Colarusso as Deputy Receiver of Taxes at the annual salary of $1,000.            .

          That Nina Caporale be appointed Town Assessor with the remainder of the term to expire September 30, 2013 and the annual salary be  $17,000.

That Bernard Szarek be appointed Clerk to the Assessor and the salary be             $10.00 per hr.

That each member of the Board of Assessment Review be paid an annual salary of $312.00.

That the annual salary for Dianne Tuttle, Town Clerk, be the sum of $42,228.

          That the Town Clerk appoint Caryl Galinski full-time Deputy Town Clerk at an annual salary of $24,987.

          That the annual salary of Dianne Tuttle, Registrar of Vital Statistics, for 2012 be $1,543.

         That the annual salary of Caryl Galinski, Deputy Registrar of Vital Statistics , for 2012  be $1,381. 

 

That the salary for Marc Goldberg, Sub Registrar of Vital Statistics,

for 2012 be $11.37 per hour.

          That the Town Board appoint Felt Evans, L.L.P. as Attorney for the Town:

$40,000 general matters and $15,000 allocated for litigation and non-retainer matters.

          That Dianne Tuttle and Caryl Galinski be appointed Dog Control Clerks and the annual salary be $3,169.each.

          That the annual salary for Jonathan Scott, Superintendent of Highways, be the sum of $57,594.

          That Jonathan Scott be appointed MS4 Officer (Municipal Separate Stormwater Sewer System) and the stipend be $5,150.

          That the Superintendent of Highways appoint Paul Grube as Deputy Highway Superintendent and the stipend be $6,378 in addition to his MEO pay.

          That the Highway Department employees' salaries are set by the Union contract.

          That Michael Orsino be appointed Recreation Maintenance Superintendent and the annual salary be $48.190, plus a $9,000 stipend.

That Patricia Maxam be appointed Director of Operations and the annual salary be $20,655 .          

That Nathan Meyer, Jr. be appointed Director of the Senior Citizen Center and the annual salary be $12,087.      

That Supervisor Meelan appoint Richard L. Williams as Town Historian and the annual salary be $1,136.

That Supervisor Meelan appoints himself as Town Police Commissioner at no salary.

          That Daniel English be appointed Chief of the Kirkland Police Department and the annual salary be $67,523.

       That Charles Kriz be appointed full time Town Police Officer and the annual salary be $51,034.  That Gene Sinardo, Jr.  be appointed full time Town Police Officer and the annual salary be $47,848. That Peter Cania IV be appointed full time Town Police Officer and the annual salary be $39,623.          That Fredrick Peck be appointed full time Town Police Officer and the annual salary be $33,439 and Christopher Paravati be appointed full time Town Police Officer and the annual salary be $33,439.

That Horace Knight, Rex Mazur, Jason Livingston, David Amodio, Daniel Buley, Robert Roberts, Peter L. Hawes and Frank McCully be appointed part-time Town Police Officers and the rate of pay be $20.10 per hour. 

That Kevin Griffin be appointed Building Inspector and Flood Control Officer and is one of the Code Enforcement Officials and the annual salary is $14,983.

          That Michael Griffin be appointed Zoning & Code Enforcement Officer  and is one of the Code Enforcement Officials and the annual salary be $14,654.

          That Michael Griffin be appointed Fire Code Inspector and the rate of pay be $15.00 an hour.

That Michael Getnick be appointed Chairman and Counsel and member of the Zoning Board of Appeals and the annual salary be $11,010.

          That each Zoning Board of Appeals member be paid the annual salary of $1,850.           

That John Cosgrove be appointed Secretary to the Planning Board and the annual salary be $7,185.                       

That Melinda Albertine be appointed Planning Coordinator and the annual salary be $15,002.

 That Elizabeth Braun be appointed part-time Planning and Codes Clerk and the salary be $11.03 per hour.                      .

That Planning Board members be paid the annual salary of $1,439.        Chairman $1,800.                  

          That the rate of pay for Transfer Station Attendant not to exceed $16.50       per hour.

Further, that Town officials be allowed a mileage allowance for use of personally owned automobiles used for Town business at the rate of 40 cents per mile.

That the Clinton Courier be named the Town Official Newspaper.

          That the two regular monthly meetings of the Town Board be held at 7:00 p.m. at the Town of Kirkland Municipal Building, 3699 State Route 12-B, Clinton, with the first regular meeting to be held the second Monday of each month except in the months of  January, February, October and November.

          That the National Bank and Trust Company be named Depository of Town Funds and that the Town Supervisor is authorized to sign contractual agreements with NBT, N. A. for all banking programs and purposes.

          That salaries of Town Officials and employees shall be paid bi-weekly with the following exceptions:

--- Dog Control Clerks, Justice and Justice Clerks, Receiver of Taxes, Town Supervisor, Town Board members, Building Inspector and Zoning & Codes Enforcement Officer shall be paid monthly.

---Deputy Town Supervisor, Registrar of Vital Statistics and Deputy Registrar, Historian and members of the Board of Assessment Review, Planning Board & Zoning Board of Appeals shall be paid annually.

---Budget Director to be paid bi-annually; First payment in June and second payment after the budget has been adopted by the Town Board.

 Supervisor Meelan made Committee assignments for the year 2012 as follows:

HIGHWAY DEPT.  LIAISON - Councilman O'Neil

RECREATION DEPT. LIAISON, ARENA & TOWN PARK - Councilman Lomanto

BUILDINGS & GROUNDS - Councilman  O'Neil

SAFETY INSPECTORS LIAISON-  Councilman Arcuri

FIRE LIAISON - Councilman Lomanto

SENIOR CITIZENS LIAISON-  Councilman Lewis

SEWER LIAISON - Councilmen Arcuri

SOLID WASTE (SWOCO) - Councilman Lewis

PLANNING BOARD LIAISON- Supervisor Meelan

INSURANCE - Supervisor Meelan

RESOLUTION #1

Upon motion of Councilman O'Neil, seconded by Councilman Arcuri the following resolution was presented:

RESOLVED, that the Town Board approve the preceding appointments, salaries and directives.

Upon the roll call vote, five voted aye, none opposed and the resolution was declared adopted.

RESOLUTION #2

Upon motion by Councilman Lewis, seconded by Councilman O'Neil the following resolution was presented:

RESOLVED, that the Town Board adopt the Cash Management and Investment Policy as printed in the Town of Kirkland Code Book.

Upon the roll call vote, five voted aye, none opposed and the resolution was declared adopted.

 

Supervisor welcomed Boy Scout Troop #44 from Clark Mills, who were observing the meeting.  They are working on their Citizenship in the Community merit badge.

Supervisor Meelan said that Attorney Hallak reviewed all the 2012 contracts and recommended approval.  He noted that the Clinton Youth Foundation agreement is not being considered at this time because there was an article in the Courier reporting that the Clinton Central School might not reopen the pool next summer.

RESOLUTION #3

Upon motion by Councilman O'Neil, seconded by Councilman Lomanto the following resolution was presented:

RESOLVED, that the Kirkland Town Board approve the following 2012 contracts with the Town of Kirkland:

Kirkland Art Center

Kirkland Town Library

Attorney for the Town Contract with Felt Evans, LLP

Oneida County DWI

Animal Control Contract with the Town of New Hartford

Sheltering Agreement with Stevens-Swan Humane Society of Oneida County,Inc.

Upon the roll call vote, five voted aye, none opposed and the resolution was declared adopted.

Attorney Hallak reviewed the Full Environmental Assessment Report from C. Lewis Tomaselli Architects regarding the Petition for a zone change on NYS Route 12B.  The Developer, David Lane, on behalf of Hamlin House Ltd., requested a zone change from Residential to Planned Development.  Attorney Hallak requested that the Report be sent to the Town's consulting engineer for his consideration, review and comment.

Supervisor Meelan thought that the Planning Board should also consider rezoning the entire corridor to Planned Development.  He added that if the Planning Board recommends approval of the spot zoning, it would be three years before they could reexamine the zoning.

Police Chief English reported that there were 158 complaints in December:  115 in the Town and 43 in the Village.  He informed Board members that the 2006 Dodge Charger was sold for $8,000 on Oneida County e-bay.  Chief English requested that Robert Scribner be appointed as a part time Police Officer to aid in replacing full time Police Officer Samuel Scotellaro, who is working in the Attorney General's office.  Police Officer Scribner is a Town resident, worked for the Madison County Sheriff's Office and transferred to the Unified Court Police.

RESOLUTION #4

Upon motion by Councilman Lewis, seconded by Councilman O'Neil the following resolution was presented:

RESOLVED, that the Kirkland Town Board appoint Police Officer Robert Scribner as a part time Police Officer for the Town of Kirkland, effective January 11, 2012.

Upon the roll call vote, five voted aye, none opposed and the resolution was declared adopted.

Board members reviewed the Safety Inspectors' reports for December.

Councilman Arcuri informed Board members that there was an Editorial in the Utica Observer Dispatch entitled "Make Policies on Town Ethics Easily Accessible".  The article noted that of all the sites checked, only the Town of Kirkland made it easy for a site user to find the Town's ethics policy simply by searching for "ethics" on its home page.

There being no further business to come before the Town Board, upon motion by Councilman O'Neil, seconded by Councilman Arcuri the meeting was adjourned at 7:30 p.m.
