Minutes of the Regular Meeting of the Town Board of the Town of Kirkland held at the Town of Kirkland Municipal Building, 3699 NYS Route 12B, Clinton, Oneida County, New York on March 12, 2007, 7:00 p.m.

            Supervisor Foley called the meeting to order and asked all present to stand for the Pledge of Allegiance.

            David Anderson, Fountain Street, asked Supervisor Foley for clarification on her letter in the Courier regarding cancellation of the July 4th parade this year.

            Supervisor Foley explained that it was decided at the budget workshop not to fund the 2007 Fourth of July parade, but leave $3,500 in the budget for the fireworks display.  She went on to explain that her letter regarding cancellation of the July 4th parade, which was printed in the Courier, was not meant for publication, but the letter was sent as a courtesy to the Mr. & Mrs. Kershner because they were so kind to sponsor the children's bicycle decorating activity.    Mrs. Foley has received calls from people in the community and from representatives of the Veterans of Foreign Wars, American Legion and Hamilton College who are interested in supporting a parade.  Jack Lane will call a meeting of interested groups to arrange for financial backing for the parade.  Supervisor Foley will attend this meeting.  Councilmen Yando and O'Neil agreed that they would not like to lose the parade.

            Mr. Kershner asked Supervisor Foley the logic behind funding $3,500 for the fireworks but not providing enough money to support the purely local parade including Boy Scouts, Cub Scouts, Girl Scouts, youth organizations, senior citizens and Veterans' groups.

            Supervisor Foley explained that there is a very large number of people who come to the Town and a very large number of Kirkland residents who attend the fireworks display.  People have told her over the years that they could not make the parade because of family commitments such as picnics, but they bring their family to the fireworks.

            Kevin Griffin, Code Enforcement Officer, made a presentation to the Board regarding his duties as Building Inspector.  Mr. Griffin detailed the building permit process and explained frequently asked questions from the public.  He also touched upon Section 1203 of the Executive Law, effective January 1, 2007, regarding administration and enforcement of the Uniform Fire Prevention and Building Code (Uniform Code).  Agricultural buildings are now exempt from building permits.  Mr. Griffin prepared an Exempt Construction Notification form in order to notify the Assessor of new agricultural structures.  Mr. Griffin explained that he handles code or safety violations for new construction, renovation or demolition and Gary Schreppel, Fire Code Inspector, handles the pre-existing construction complaints.  Mr. Griffin also explained his duties as Flood Control Officer.

A motion was made by Councilman Meelan, seconded by Councilman O'Neil to approve the minutes of February 26, 2007 as printed.

            Upon the roll call vote, three voted aye, one abstained and the motion was declared carried.  (Councilman Venero absent)

            Jonathan Scott, Superintendent of Highways, reported that he purchased a used snow blower that attaches to the front of a front-end loader.  The snow blower cleared an area on Skyline Drive in an hour that would have taken his crew 6-7 hours previously.  Board members went outside to view the new machine.

            Board members had no objection to Clinton Fish & Game Club, Lumbard Road, renewing their beer license.

            The Town Clerk requested that $200 be transferred from the Records Management contractual line to personal services to hire Marc Goldberg for twenty more hours.  Mr. Goldberg did not work with the Town records last year because he was Deputy Town Clerk and more work needs to be done in the Record Center.

            RESOLUTION #10

            Upon motion of Councilman Yando, seconded by Councilman Meelan the  following resolution was presented:

            RESOLVED, that the Kirkland Town Board transfer $200 from A1460.4 (Records Management - Contractual) to A1460.1 (Personal Services) to hire Marc Goldberg, Records Retention Coordinator, for twenty more hours.

            Upon the roll call vote, four voted aye, none opposed and the resolution was declared adopted.  (Councilman Venero absent)

            Police Chief English reported that 259 calls were received, 90 in the Town, 66 in the Village, 12 arrests, 156 traffic tickets and 37 parking violations were issued.  He reported that the first truck inspection checks with NYS Department of Transportation took place February 27th.  The inspections took place behind the Highway Garage.  There were a few hazardous material violations.    Chief English said that within a half hour after inspections started there were no commercial vehicles on Route 12B because the word spread about the inspections.

            Councilman Meelan reported that youth hockey hosted a Girls Sixteen and Under State Tournament at the Arena and the staff is gearing up for the ice show.

            Board members reviewed the Safety Inspectors' reports for February.

            Supervisor Foley informed the Board that Oneida County has been declared eligible for reimbursement from the Federal Government for some of the associated costs of snow removal during February 2 through 12.

            Mrs. Foley attended the first meeting of the 2010 Census workshop.

            A motion was made by Councilman Meelan, seconded by Councilman O'Neil to pay the bills as audited. 

            Upon the roll call vote, four voted aye, none opposed and the motion was declared adopted.  The totals were:

A motion was made by Councilman Yando, seconded by Councilman O'Neil to enter into executive session to discuss a personnel matter.

Upon the roll call vote, four voted aye, none opposed and the motion was declared carried.

There being no further business to come before the Town Board, upon motion by Councilman O'Neil, seconded by Councilman Yando the meeting adjourned at 8:35 p.m.
