February 12, 2007: Town Board Meeting Minutes

Body:

Minutes of the Regular Meeting of the Town Board of the Town of Kirkland held at the Town of Kirkland Municipal Building, 3699 NYS Route 12B, Clinton, Oneida County, New York on February 12, 2007, 7:00 p.m.

 

Present:

Supervisor Annette S. Foley          

Councilman Harvey N. Yando                  

Councilman Nicholas S. Venero

Councilman Michael D. O’Neil

Absent:

Councilman Robert J. Meelan

 

Attorney for the Town:  Anthony G. Hallak, Esq.

 

          Supervisor Foley called the meeting to order and asked all to stand for the Pledge of Allegiance.

          Attorney Hallak informed Brian Savicki that there were no petitions for waiver filed for the Wind Energy Conversion System Moratorium Law.

          Jay Burmaster, NYS Route 12, noted that his brother received a Notice of Violation and $50 fine regarding an unregistered vehicle for sale on the property in the Township.  Attorney Hallak will explain to Mr. Burmaster Chapter 69 of the Town Code entitled “Junk Vehicles”.

          A motion was made by Councilman Yando, seconded by Councilman O’Neil to approve the minutes of January 17, 2007 as printed. 

          Upon the roll call vote, four voted aye, none opposed and the motion was declared carried.  (Councilman Meelan absent)

          Attorney Hallak reported that he received a copy of the engineering report regarding Alterra from the Village.  The CT Male fire study raises questions about the inadequacy of the fire flow.  Mr. Hallak said that the water line is a private line owned by Alterra and not owned by the Town.  Board members agreed that Attorney Hallak along with a Village representative should open some dialogue with Alterra to see about Alterra’s maintenance plan and how they plan to bring their fire flow up to standard.

          Board members had no objection to Joanna Kurdziolek renewing the liquor license for Birdies, Eagles and Ducks Public Golf Course located at 151 Kirkland Avenue.

The Town Clerk received a request from Sherry DePerno, Executive Director of ALS of Utica (AKA Lou Gehrig’s disease) to sell raffle tickets in Kirkland for 2007. 

RESOLUTION #7

Upon motion of Councilman Venero, seconded by Councilman Yando the following resolution was presented:

RESOLVED, that the Kirkland Town Board allow members of the ALS of Utica to sell raffle tickets in the Town of Kirkland for 2007.

Upon the roll call vote, four voted aye, none opposed and the resolution was declared adopted.  (Councilman Meelan absent)

Police Commissioner Venero reported that a letter of resignation was received from Patrolman Michael Coughlin.  Commissioner Venero said that part-time Patrolman Coughlin worked for the Town for 19 years and was an excellent police officer.

RESOLUTION #8

Upon motion of Councilman Venero, seconded by Councilman Yando the following resolution was presented:

RESOLVED, that the Kirkland Town Board accept the resignation of part-time Patrolman Michael J. Coughlin, effective January 31, 2007.

Upon the roll call vote, four voted aye, none opposed and the resolution was declared adopted.  (Councilman Meelan absent)

Anthony Hallak, Liaison to the Planning Board, explained that the Town Board received a petition from Robert & Mary Good in January.  The Petition for Amendment to the Zoning Ordinance related to the Good’s property on NYS Route 5.  After some examination of the maps and discussions with the County Planning Department, the property, in fact, may be zoned Commercial.  The matter will be referred to the Zoning Board of Appeals for interpretation of the Zoning Map.

Councilman Venero reported that the arena is gearing up for the Division II hockey sectionals and the figure skating ice show.

Supervisor Foley reported that the Clinton Kiwanis Club will be providing dessert and treats to the Kirkland Senior Citizens for their Valentine’s Day party.

Councilman Venero reported that there was a SWOCO organizational meeting and the following officers were approved:  Jack Lane, Chairman; Donald  Cossett, Manager; Nicholas Venero, Treasurer and Felt Evans, LLP, Attorney.

Board members reviewed the Safety Inspectors’ Reports.

Supervisor Foley will attend a meeting for Mayors and Supervisors  regarding the 2010 census preparation.

Supervisor Foley noted that the Town will lose the $1.9 million, interest free, loan from the NYS Drinking Water Revolving Fund for the Route 5 water project.  The town has to pay back $47,000 for engineering and archeological studies that were required in order to qualify for the grant.

A report was received from Oneida County Department of Public Works regarding the intersection of Clinton Street, Main Street and Pratt Avenue in Clark Mills.  There were two recommendations listed:  1.  Take no action at this time; 2.  The Town should consider prohibiting parking along Clinton Street adjacent to the intersection to insure that the drivers’ line of sight is not obstructed.

A motion was made by Councilman Venero, seconded by Councilman O’Neil to pay the bills as audited.  Upon the roll call vote, four voted aye, none opposed and the motion was declared carried.  The totals were:

A - $63,388.57, Claim #141-219, 269-272; B -  $18,087.69, #220-251

DA - $51,037.40, #252-266; DB - $614.15, #267, 268

SF1 - $135,363.00, #273, 274; SS1 - $29,147.95, #275-283; SS2 - $25.21, #284

          A motion was made by Councilman Yando, seconded by Councilman O’Neil to enter into executive session to discuss litigation and contract negotiations.

          Upon the roll call vote, four voted aye, none opposed and the motion was declared carried.  (Councilman Meelan absent)

          A motion was made by Councilman Venero, seconded by Councilman O’Neil to adjourn the executive session.

          Upon the roll call vote, four voted aye, none opposed and the motion was declared carried.  (Councilman Meelan absent)

          There being no further business to come before the Town Board, upon motion of Councilman Yando, seconded by Councilman O’Neil the meeting was adjourned at 8:22 p.m.
