Body:

Minutes of the Organizational and Regular Meeting of the Town Board of the Town of Kirkland held at the Town of Kirkland Municipal Building, 3699 NYS Route 12B, Clinton, Oneida County, New York on January 3, 2007, 7:00 p.m.

          Dianne Tuttle, Town Clerk, administered the Oath of Office to Michael D. O’Neil, Councilman and Jonathan T. Scott, Superintendent of Highways.

          The organizational meeting was called to order by Supervisor Foley.

          The following motions were introduced for the 2007 appointments and salaries:

          That the annual salaries for Councilmen Meelan, Yando, Venero, and O’Neil be the sum of $4,884. each.

          That the annual salaries for Vincent Scholl and Paul Heintz, Town Justices, be the sum of $13,807. each.

          That Lois Scholl and Patricia Curtacci be appointed Justice Clerks and the annual salaries be $8,263. each.

          That the annual salary for Town Supervisor Annette Foley be $15,597.              and as Town Budget Director be $ 4,569.

          That Supervisor Foley appoint Harvey Yando, Deputy Town Supervisor and the annual salary be $1,000.

          That Rose Marie Arcuri be appointed Supervisor’s Secretary and the annual salary be $37,226.

That Julie Rotondo be appointed Assistant Supervisor’s Secretary and the annual salary be $18,299.

          That the annual salary for Ernest E. Randall, Receiver of Taxes, be the sum of $9,429.

          That the Receiver of Taxes appoint Janice Hogan as Deputy Receiver of Taxes at the annual salary of $1,000.

          In conjunction with the Assessor’s agreement with d. Burth Realty, Inc. Dean Burth, as Assessor, will receive $18,600.

That Nina Caporale be appointed as part-time Data Entry Operator for the Assessor’s Office and the annual salary be $9,639.

That each member of the Board of Assessment Review be paid an annual salary of $275.

          That the annual salary for Dianne Tuttle, Town Clerk, be the sum of $37,157.

          That the Town Clerk appoint Caryl Galinski full-time Deputy Town Clerk at an annual salary of $21,986.

          That the annual salary for Dianne Tuttle, Registrar of Vital Statistics, be $1,357.

That the annual salary for Caryl Galinski, Deputy Registrar of Vital

 Statistics, be $1,215.   

That the salary for Marc Goldberg, Sub registrar of Vital Statistics, be

$10 per hour.

That the Town Board appoint Felt Evans L.L.P. as Attorney for the Town at $35,000.

          That Dianne Tuttle and Caryl Galinski be appointed Dog Control Clerks and the annual salary be $1,429 each.

          That the annual salary for Jonathan Scott, Superintendent of Highways, be the sum of $50,677.    

          That the Superintendent of Highways appoint Paul Grube as Deputy Highway Superintendent and the stipend be $6,162 in addition to his MEO pay.                       That the Highway Department employees’ salaries are set by the Union contract.

          That Michael Orsino be appointed Recreation Maintenance Superintendent and the annual salary be $42,403. plus a $9,000 stipend.      

          That Nathan Meyer, Jr. be appointed Director of the Senior Citizen Center and the annual salary be $10,955.

That Supervisor Foley appoint Richard L. Williams as Town Historian with the term to expire December 31, 2007, and the annual salary be $1,000.

That Supervisor Foley appoint Nicholas Venero Town Police Commissioner at no salary.

          That Daniel English be appointed Chief of the Kirkland Police Department and the annual salary be $59,424.

       That Seth Cresswell and Charles Kriz be appointed full time Town Police Officers and the annual salary be $42,933.  That Gene Sinardo be appointed full time Town Police Officer and the annual salary be $40,000, Peter Cania IV be appointed full time Town Police Officer and the annual salary be $34,755, and Wayne Smoulcey be appointed full time Town Police Officer and the  annual salary be $31,867.

That Christine Griffin, Horace Knight, Vito Sparace, Rex Mazur, Shawn Occhipinti, Jason Livingston, Dave Amodio be appointed part-time Town Police Officers and the rate of pay be $17.68 per hour.

That Kevin Griffin be appointed Building Inspector, Deputy Sanitary & Sewer Inspector, and Flood Control Officer and is one of the Code Enforcement Officials and the annual salary be $13,183.

          That Ronald Mortis be appointed Sanitary and Sewer Inspector and is one of the Code Enforcement Officials and the annual salary be $11,748.

          That Michael Griffin be appointed Zoning & Code Enforcement Officer and Deputy Fire Code Inspector and is one of the Code Enforcement Officials and the annual salary be $12,893.

          That Gary Schreppel be appointed Fire Code Inspector,  Deputy Building Inspector and Stormwater Management Officer, and is one of the Code Enforcement Officials and the annual salary be $10,400.

          That Michael Getnick be appointed Chairman and Counsel and member of the Zoning Board of Appeals and the annual salary be $9,979.

          That Michael Lopata  be appointed to the Zoning Board of Appeals with the term to expire December 31, 2010.

That each Zoning Board of Appeals member be paid the annual salary of $1,677.       

That John Cosgrove be appointed Secretary and Legal Counsel for the Planning Board and the annual salary be $6,322.       

That Melinda Albertine be appointed Secretary for the Planning Board  and the annual salary be $13,200.

That Elizabeth Braun be appointed part-time Planning and Codes Clerk and the salary be $10.00 per hour.                      .

That Francis Lallier be reappointed to the Planning Board with the term to expire on December 31, 2011.

That Planning Board members be paid the annual salary of $1,266. and  Chairman $1,583.          

          That Robert Galinski be appointed in charge of the maintenance of the Clark Mills Sewer District and the rate of pay be $16.88 per hour.

That the rate of pay for Transfer Station Attendant be set at $11 per hour.

Further, that Town officials be allowed a mileage allowance for use of personally owned automobiles used for Town business at the rate of 35 cents per mile.

That the Clinton Courier be named the Town Official Newspaper.

          That the two regular monthly meetings of the Town Board be held at 7:00 p.m. at the Town of Kirkland Municipal Building, 3699 State Route 12-B, Clinton, with the first regular meeting to be held the second Monday of each month except in the months of January, July, October, and November.

          That the National Bank and Trust Company be named Depository of Town Funds and that the Town Supervisor is authorized to sign contractual agreements with NBT, N. A.  for all banking programs and purposes.

          That salaries of Town Officials and employees shall be paid bi-weekly with the following exceptions:

---Building Inspector, Dog Control Clerks, Fire Code Inspector, Receiver of Taxes, Sanitary & Sewer Inspector, Supervisor, Town Board members, Town Justices & Justice Clerks, and Zoning & Codes Enforcement Officer shall be paid monthly.

---Deputy Town Supervisor, Registrar of Vital Statistics and Deputy Registrar, Historian and members of the Board of Assessment Review, Planning Board & Zoning Board of Appeals shall be paid annually.

           Supervisor Foley made Committee assignments for the year 2007 as follows:

HIGHWAY COMMITTEE – GENERAL LIAISON – Councilman Yando and Councilman O’Neil        

INSURANCE – Supervisor Foley & Councilman Yando

RECREATION COMMITTEE – Councilman Meelan and Councilman Venero

SOLID WASTE (SWOCO) – Councilman Venero

PUBLIC SAFETY (FIRE LIAISON) & SAFETY INSPECTIONS – Councilman Venero

PLANNING BOARD LIAISON – Supervisor Foley and Atty. Anthony Hallak

BUILDINGS & GROUNDS – Councilman Meelan

SENIOR CITIZENS –  Supervisor Foley

DEVELOPMENT:  INDUSTRIAL & RESIDENTIAL –  Supervisor Foley

GRANTS – Councilman O’Neil

ROUTE 5 WATER – Councilman Yando

SEWERS – Councilman O’Neil and Councilman Meelan

RESOLUTION #1

Upon motion by Councilman Meelan, seconded by Councilman Venero the following resolution was presented:

RESOLVED, that the Town Board approve the preceding appointments, salaries and directives.

Upon the roll call vote, five voted aye, none opposed and the resolution was declared adopted.

RESOLUTION #2

            Upon motion by Councilman Meelan, seconded by Councilman O’Neil the following resolution was presented:

  RESOLVED, that the Town Board adopt the Cash Management and Investment Policy as printed in the Town of Kirkland Code Book.

       Upon the roll call vote, five voted aye, none opposed and the resolution was declared adopted.

The Town Board will annually review the Procurement Policy as printed in the Town of Kirkland Code Book.

Supervisor Foley called the regular meeting to order at 7:16 p.m. and asked all to stand for the Pledge of Allegiance.

Board members unanimously agreed to refund $50 to Dennis Hartman, for Building Permit #1683.  A letter of request from the Planning Board noted that Mr. Hartman filled out a building permit to open a business to provide services to veterinary clinics, but he is not able to use that building at this time.

Each Board member received a copy of the brochure entitled “Town of Kirkland Cemeteries”, prepared by Richard Williams, Town Historian.

Superintendent of Highways Scott reported that his crew has been getting a head start on summer activities due to the unusually warm weather.

Police Chief English reported that there were 267 complaints in December, 269 traffic tickets and 3 DWI tickets.  He also noted that the District Attorney’s office is moving records from the Command Post located in the Senior Citizen Building to the Oneida County Court House for the trial of John Healy regarding the death of Officer Joseph Corr last February.  (see minutes of March 13, 2006)  Chief English also noted that Hamilton College Town & Gown Committee gave the Kirkland Police Department a $6,500 grant for police training for the KPD and Hamilton College Campus Safety.

Councilman Meelan said that there was two hours of Public Skating at the Arena on New Years Eve.  Seven hundred dollars was generated in revenue even though Town residents had free admission because it was Sunday.

Board members reviewed the Safety Inspectors’ reports.

A motion was made by Councilman Meelan, seconded by Councilman Yando to enter into executive session to discuss pending and threatened litigation.

Upon  the roll call vote, five voted aye, none opposed and the motion was declared carried.

A motion was made by Councilman O’Neil, seconded by Councilman Venero to adjourn the executive session.

There being no further business to come before the Town Board, upon motion of Councilman Venero, seconded by Councilman O’Neil the meeting was adjourned at 8:25 p.m.
